GARAGE BUSINESS: PURCHASE OF SECTIONAL DOORS
The consumer has concluded a purchase and sale agreement with Vinsera LLC UNP 691148595 for the purchase of garage sectional doors with component elements. According to the terms of the contract, he paid 43% of the total cost of the gate immediately, and had to pay the rest of the amount after their installation. 2.5 months later, the Seller delivered the order to the Consumer, violating the clause of the contract on the procedure for transferring the goods and began to install. During the installation of the gate frame, the Seller's employees made a lot of extra holes while ruining the paintwork. Upon seeing this flaw, the Consumer refused to continue the installation, considering the product to be of inadequate quality and demanded replacement. The Seller's employees accepted the claim and left, leaving the product to the Consumer. And three weeks later, a "new" gate frame was brought, which was scratched. The consumer again refused to accept the product, demanding to replace it with a product of proper quality. Without receiving approval for the installation of the frame, the Seller's employees dismantled the previously installed frame and took it with them. For the third time, the Seller showed ingenuity, he brewed, sanded and painted over the holes in the frame of the gate and offered for installation, but the Consumer stood his ground, not agreeing to accept a product in which flaws were eliminated. After that, the Seller left the product to the Consumer, left and did not get in touch again, despite the Consumer's attempts to communicate with him.
In search of help, the Consumer turned to the Polotsk district organization of the Public Association "Belarusian Consumer Protection Society", whose employees gave legal advice and began work on resolving the dispute. The seller contacted and offered to complete the work under the contract, as in his opinion there were no flaws in the gate itself. Employees of the Public Association, in order to verify the words of the Seller and study the consumer properties of the product, went to the Consumer for inspection. Upon inspection, it turned out that the gate opening in the Consumer's building is larger than the gate itself, and the presence of welding traces painted over on the gate frame was also confirmed. Based on the conducted research, employees of the Polotsk district organization of the Public Association "Belarusian Consumer Protection Society" came to the conclusion that this product, in accordance with the Law "On Consumer Protection", is characterized as a product of inadequate quality. A notice was sent to the seller demanding that the transaction be terminated, but it was left without consideration. In this connection, the Consumer instructed the Public Association to protect his interests in court.
During the trial, the court defended the Consumer and ordered Vinsera LLC to return the amount of money paid to the Consumer, pay a penalty and compensate for moral damage, as well as reimburse court costs and pay a fine. Unfortunately, to date, Vinsera does not comply with the court's decision, and therefore, the enforcement department has initiated enforcement proceedings, which is confirmed by information posted on the website of the Ministry of Justice of the Republic of Belarus.
