In accordance with Article 470 of the Civil Code of the Republic of Belarus, the buyer is obliged to pay for the goods at the price announced by the seller at the time of conclusion of the retail sale agreement. Therefore, the buyer has the right to demand from the seller the sale of the goods at the price indicated on the price tag.
According to paragraph 1 of Article 465 of the Civil Code of the Republic of Belarus, paragraph 1 of Article 7 of the Law of the Republic of Belarus dated January 9, 2002 No. 90-Z "On Consumer Rights Protection", the seller is obliged to provide the buyer with the necessary and reliable information about the product offered for sale.
THE SELLER'S RESPONSIBILITY FOR VIOLATING THE REQUIREMENTS FOR THE DESIGN OF PRICE TAGS
Article 16 of the Law on Consumer Protection provides for the civil liability of the seller for providing false information about the product.
For violation of the rules of trade and provision of services to the public, Part 1 of Article 12.17 of the Administrative Code of the Republic of Belarus, the seller faces a fine of up to 10 basic units. And for repeated violation within one year after the imposition of an administrative penalty - a fine of 10 to 30 basic units (Part 3 of Article 12.17 of the Administrative Code).
In accordance with Article 3.30 of the Procedural and Executive Code of the Republic of Belarus on Administrative Offenses, protocols on administrative offenses under parts 1 and 3 of Article 12.17 of the Administrative Code have the right to be drawn up by authorized officials of the bodies of the State Control Committee of the Republic of Belarus, the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus, rural, settlement, district, city and regional executive committees, district administrations in cities.
In accordance with paragraph 3 of Decree of the President of the Republic of Belarus No. 567 dated December 5, 2014 "On additional measures to protect consumer rights", the Minister of Trade and his deputies were granted the right to suspend the operation of a retail facility, a catering facility for up to 90 days if violations of legislation on pricing, trade are established based on the results of an inspection of such an object and public catering. In addition, the Minister of Trade has been granted the right to prohibit the operation of a commercial facility, a catering facility in the event of non-elimination of violations identified by the results of the inspection within the time period specified in the regulation or in the case of repeated violations that served as the basis for suspending the operation of such an object, within a year from the date of suspension of its work.
