In 2024, according to the Labor Code of the Republic of Kazakhstan, the normal working time should not exceed 40 hours per week. For a five-day workweek, this is 5 working days of 8 hours, and for a six-day workweek, it is 5 days of 7 hours and 1 day of 5 hours, or 6 days of 6 hours and 40 minutes.
79 of the Labor Code of the Republic of Kazakhstan, organizations must keep records of the working time actually worked by an employee.
With a five-day work week, the duration of daily work (work shift) may not exceed 8 hours with a weekly rate of 40 hours.
In accordance with clause 80, clause 1, Article 1 of the Labor Code of the Republic of Kazakhstan, overtime work is work performed by an employee on the initiative of the employer outside the established working hours.
According to Article 77 of the Labor Code of the Republic of Kazakhstan, overtime work is allowed only with the written consent of the employee, except in cases provided for in paragraph 2 of this article.
At the same time, overtime work should not exceed two hours for each employee during the day, and one hour for heavy work, work with harmful and (or) dangerous working conditions.
The total duration of overtime work should not exceed twelve hours per month and one hundred and twenty hours per year in accordance with paragraphs 1, 2 of art. 78 of the Labor Code of the Republic of Kazakhstan.
When keeping records of working hours, overtime, weekends, and holidays are taken into account (paragraph 2 of Article 79 of the Labor Code of the Republic of Kazakhstan).
In case of time-based payment, overtime work is paid in an increased amount according to the terms of labor or collective agreements and/or an act of the employer, but not less than one and a half times based on the employee's rate.
In case of piecework, the additional payment for overtime work is made in the amount of not less than fifty percent of the employee's established rate.
By agreement of the parties, it is allowed to provide rest hours for working overtime at the rate of at least one hour of rest per hour of overtime.
The Code of Administrative Violations of the Republic of Kazakhstan, in paragraphs 3, 4 of Article 87, provides for administrative punishment for violating the requirements of the labor legislation of the Republic of Kazakhstan for overtime pay, work on holidays and weekends, as well as nighttime pay, entails a fine of thirty for officials, small businesses or non-profit organizations in the amount of sixty, for medium-sized businesses in the amount of eighty, for large businesses in the amount of one hundred and twenty monthly calculation indices.
The actions provided for in the third part of this Article, committed repeatedly within a year after the imposition of an administrative penalty,

Illegal excess by an employer of the normal and reduced working hours and daily work (work shift) provided for by the labor legislation of the Republic of Kazakhstan entails a warning.
The action provided for in the first part of this article, committed repeatedly within a year after the imposition of an administrative penalty, entails a fine of forty for officials, sixty for small businesses or non-profit organizations, eighty for medium-sized businesses, and one hundred and twenty monthly calculation indices for large businesses.
